5. SHIPMENTS:

Delivery time is usually between 1 or 2 working days, depending on destination. This term is understood if the availability of the goods has been confirmed and the full payment of the order has been verified.

9.1 Right of withdrawal:

The user has 14 calendar days, counted from product’s the date of delivery, to the return it (art. 71 Law 3/2014, of March 27th). If you are not satisfied with the product or any products of your order, you may exercise your right of withdrawal by filling out the form attached to these conditions, with your order number and your contact details (to obtain the reimbursement of the amount of the product (s) within a maximum period of following fourteen (14) calendar days to reception of the order). 9.3 Return of non-defective product:

When the product has no defect and its return has been motivated by ignorance or misuse, ACJ Systems, S.L. will contact you to indicate the steps to continue for the recovery of the product.
Shipping costs arising from the return of a product that does not have any defect or damage will be borne by the client and ACJ Systems, S.L. will not proceed to accomplish this shipment until having received the payment of the costs of transport in advance. Verification of the product’s malfunctions, by ACJ Systems, S.L. resulting from misuse or poor protection during the shipment may entail the cancellation of the Guarantee or cause a decrease in the value of the product.

10. REFUNDS:

10.1 Refund of shipping costs:

If you request the reimbursement of return’s shipping costs you must send the products by standard mail (ordinary letter). 10.2 Reimburse for return:

11. APPLICABLE GUARANTEES AND AFTER-SALES SERVICES:

11.1 Guarantee:

c) Are suitable for any special use required by the customer when he/she has put it in knowledge of ACJ Systems, S.L. at the time of the conclusion of the contract, providing that this one has admitted that the product is suitable for this use.

d) They report the standard quality and benefits of a product of the same type as the customer may reasonably expect, given the nature of it, and, when applicable, descriptions of the specific characteristics of the products made by ACJ Systems, S.L.

e) ACJ Systems, S.L. describes the details, technical characteristics and photographs of the products provided by the manufacturer, thereof, so that it is not obliged by these public statements.

2. The lack of conformity that ensues from improper product installation will be equated to the lack of conformity of the same when the installation is included in the contract of sale and has been made by ACJ Systems, S.L. or under its responsibility, or by THE USER when defective installation is due to an error in the installation instructions.

3. Liability shall not proceed for faults of conformity that the User knows or could not have ignored to ignore at the time of the conclusion of the contract or that has its origin in materials supplied by the User.

11.2 Defective products:

In case of defective product, ACJ Systems, S.L. must proceed to the repair, substitution, lowering the price or resolute the contract (as applicable), formalities that will be free for the user. ACJ Systems, S.L. responds to the faults of conformity which are manifested within two years from delivery, as long as he/she reports this lack of conformity to ACJ Systems, S.L. within two months since he/she had knowledge of it..

11.3 Suppositions of guarantee’s cancellation:

Guarantee is not applied in the following suppositions:

- Deterioration created by adaptations, adjustments or modifications made on a product without written agreement with the manufacturer,

- Expenses related to maintenance, repair or replacement of parts by normal wear,

- Faults and deterioration of accessories,

- Deterioration created by misuse of the product, inappropriate use, no respect towards the instructions of use regarding its utilization and maintenance or an improper installation,

- Damage caused by non-accredited persons or the user,

- Damage resulting from accidents, lightning, floods, fires or any other cause which is not manufacture’s responsibility,

- Damage caused by a system failure in which the product may be incorporated

- If the model or the product’s serial number shows any modification,

- Use of the product outside familiar and private framework, for example, in professional intensive use, or

- Products already repaired by Services of Repair foreign to ACJ Systems, S.L.

11.4 Replacement of an irreparable product:

In case the product is considered to be irreparable or the cost of the repair is disproportionate with regard to his value, it will be replaced with exactly equal other one. Of not being possible the above-mentioned, we will offer him/her a product of identical or superior characteristics.

Replacement of your product will terminate your purchase agreement and extensions of guarantee if any, because when you acquire you’re a new product it will be benefited with a new contract as a new purchase.

If any clause included in these General Conditions was declared, totally or partially, void or ineffective, such nullity or inefficiency will only concern the above-mentioned disposition or to the part that is null or inefficient, subsisting the General Conditions in everything else, having such a disposition, or the part of it that is affected, for not putting it.

14. APPLICABLE LAW AND JURISDICTION:

These conditions shall be governed or construed in accordance with Spanish Law in those which is not expressly established. The provider and the user agree to submit any controversy that may arise from the provision of the products or services object of these Conditions, to the Courts and Tribunals of the provider's domicile (if it is a legal person) or the user (if natural person).

In case the user is domiciled outside Spain, the provider and the user, waive expressly any other forum, submitting to the Courts and Tribunals of Barcelona city (Spain).
